Real Property - Condominiums - Repair or Replacement of Unit by Council of Unit Owners

Delegates Beidle, Healey, Holmes, King, Kipke, Lafferty, Love, Mathias, McConkey, and Niemann

Clarifying that the council of unit owners of a condominium is responsible for the repair or replacement of condominium units, exclusive of improvements and betterments installed in units by unit owners other than the developer, in the event of damage or destruction of the condominium; providing that the owner of the unit where damage originated is responsible for the council of unit owners' property insurance deductible up to $10,000; etc.

IIAM SUPPORTS W/ AMENDMENT
Note:  Deductible will remain at current $5,000

IIAM does not support the 'immediate shift' currently written into the legislation, which would allow the condominium association to assess the unit where damage originated for the deductible up to $5,000...without the by-laws addressing the assessment for the deductible.  Currently, the change must be made to the by-laws (approved by the unit owners) before the deductible may be assessed to the unit owner where damage originated.
