
Objective:
The purpose of this program is to communicate to individuals working in independent
agencies that errors and omissions losses, are for the most part, preventable. Through this seminar, one will gain understanding
of what causes the claims and how procedures can be implemented to prevent or reduce
future errors and omissions losses. You will
be asked to review your current agency operations and institute and monitor procedures
which will assist you not only in reducing the likelihood of claims, but also in
establishing good agency management practices.

Objective: What is Employment Practice Liability? It is the legal duty owed to employees in day to day employment related practices. This program reviews the dos and don'ts of hiring, firing, promotion, interviewing, providing references, employment reviews, etc. With the passage of the Civil Rights Act of 1991 and the Americans With Disabilities Act of 1990, it has become imperative for employers to protect themselves. Well publicized court cases will be reviewed, as well as the increase in awareness and thus litigation. This program is imperative for any agency owner or human resource manager. Participants receive a handbook full of ideas, sample letters, etc.

The focus of this workshop is on certificates of insurance but it also addresses critical peripheral issues such as contractual risk transfer and additional insureds, situations that often set the certificates of insurance wheels into motion.
First, the program examines what a certificate of insurance is and isn’t and takes a look at the escalating number of E&O claims involving certificates, presenting several real life claims case studies with settlements or judgments ranging from $100,000 to over $10 MILLION.
Second, the workshop discusses contractual insurance requirements and additional insureds. Included are numerous examples of indemnity agreements, construction contracts, and commercial leases and loan agreements. Topics include agent “opinion” letters, “primary and noncontributory” requirements, waivers of subrogation, notifying certificateholders of cancellation, CGL contractual liability coverage, and additional insured issues for CGL, business auto, and workers compensation coverages under ISO and proprietary company forms.
Third, various policy processing forms and issues are reviewed, including the ACORD 24, 25, 27, and 27 as to what should and shouldn’t be included on these certificates and evidences of insurance. Addressed are issues such as how to respond onerous certificate requests, dealing with competitive pressures to issue questionable certificates, sending copies of certificates to insurers, ACORD copyright caveats, using non-ACORD forms, complying with agency/company agreements, using E&S markets, agency certificate procedures, and charging fees for certificates.
The fourth major area discussed is the legal aspects of certificates. Included are statutes, regulations, and insurance department directives from states across the country, along with eye-opening case law dealing with certificates. We all know certificates are not contracts and, therefore, not actionable against agents or carriers, right? Think again. Lenders are pressing to revert the latest ACORD 27 and 28 form revisions back to pre-2006 disclaimer-free versions and plaintiff’s lawyers continue to seek, and in some cases discover, creative ways to hold agents liable.
Finally, the program concludes with an open Q&A session (for anything not already asked and responded to during the program), conclusions and recommendations, and a charge for agents to educate their employees, carriers, and venders, along with customers and other parties in non-insurance industries.
